1 ECOCIDE
Ecocide — brief overview
Definition: Ecocide refers to severe, widespread or long-term damage to, destruction of or loss of ecosystems, which may be caused by human activity or negligence.
Legal status: There is a global movement to add ecocide as a fifth core international crime to the Rome Statute (alongside genocide, crimes against humanity, war crimes, and aggression). As of March 22, 2026, ecocide has not yet been adopted into the Rome Statute, though proposals and campaign efforts (including a draft definition by an independent panel of experts) have advanced the discussion among states and civil society.
Draft definition (summary):
Criminalizes serious or widespread or long-term damage to the environment caused by human conduct.
Requires the conduct to be committed with intent, recklessness, or knowledge of substantial likelihood of causing such damage, depending on the proposed text.
Includes acts in peace time and during armed conflict, with some exceptions for lawful conduct and necessary emergency actions.
Who could be liable: Proposals cover individual criminal responsibility for political and business leaders, and potentially corporate officers, not states or corporations directly (criminal law targets persons).

2 CRIMES AGAINST HUMANITY
The Rome Statute is the international treaty that established the International Criminal Court (ICC) on July 1, 2002. It defines the court’s jurisdiction over serious crimes such as genocide, war crimes, and crimes against humanity, aiming to hold individuals accountable for these offenses.

Crimes against humanity are certain acts committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack. Key points:
Core elements:
Conduct: One of the prohibited acts (see list below).
Context: Widespread (large-scale) or systematic (organized, patterned) attack.
Target: A civilian population.
Mens rea: Knowledge of the attack as part of that attack (not necessarily specific intent to harm a particular individual).
Prohibited acts (examples under the Rome Statute):
Murder
Extermination
Enslavement
Deportation or forcible transfer of population
Imprisonment or other severe deprivation of physical liberty
Torture

Distinguishing features vs. other international crimes:
Unlike genocide, crimes against humanity do not require intent to destroy a protected group in whole or in part.
Unlike war crimes, they can occur in peacetime or wartime and do not require an armed conflict.
Responsibility:
Individuals (including state officials and armed-group leaders) can be held criminally responsible.
Commanders and other superiors may be liable for crimes their subordinates commit if they knew or should have known and failed to prevent or punish.
Examples: mass murder of civilians during ethnic cleansing campaigns, systematic torture and detention of political opponents, large-scale sexual violence used as policy.
3 GENOCIDE
Genocide is the intentional and systematic destruction, in whole or in part, of a national, ethnic, racial, or religious group.
Key elements:
Protected group: national, ethnical, racial, or religious group.
Mental element (intent): specific intent (dolus specialis) to destroy the group, wholly or partially.
Acts: any of the following when committed with the required intent:
Killing members of the group.
Causing serious bodily or mental harm to members.
Deliberately inflicting conditions of life calculated to bring about the group’s physical destruction (e.g., starvation, forced displacement).
Imposing measures to prevent births within the group.
Forcibly transferring children of the group to another group.
Legal sources:
Defined in Article II of the 1948 Genocide Convention and mirrored in Article 6 of the Rome Statute (ICC).
Burden of proof and prosecution:
Prosecutors must prove the specific intent to destroy the group — a high evidentiary threshold — plus occurrence of one or more prohibited acts.
